Would Triumph Have Liability For Assault To Wearer

Motorcycle News UK is reporting that this jacket looks quite similar to the gang logo used by the Outlaws.

A Motorcycle News reader suggests that wearing the jacket could be dangerous if the Outlaws took offense.

In this time when many providers of motorcycle and motorcycle fashion wear are looking to existing designs for graphics, it would be a good idea to at least understand the issues involved.

Now that Triumph is aware of the risk involved with this design, what would their responsibility be if an innocent purchaser wore the jacket in the wrong place?

While the first impression might be to brush this one off, on closer examination, this is a clear unnecessary risk to purchasers of the jacket. Further, the benefit of the design is small compared to the risk. You might give Triumph a pass if they did it accidentally, but they have publicly commented on the problem. At this point, they may well have responsibility to someone who innocently purchases the jacket, not knowing of the problem.

Nice Way to Wreck a Ride

This week was a bad one for me because it brought up the issue of discrimination against motorcycles.

First, I was on my Triumph Speed Triple, doing a Sunday Morning Ride kind of thing. It's been a wet winter in California, and I wanted to start warming up my riding skills for the spring season.

I get behind a car full of gang bangers at a stoplight. The thick smell of gange was beyond anything you could imagine. There were so many cues of gang activity that you really could not sort them all out. We take off from the light, go down a main thoroughfare past a major motorcycle dealer, and a cop stopped in a parking lot pulls out to follow -- me. He stays on my tail for several blocks before giving up.

It's the kind of nonsense thing that sours the end of the morning ride. We can't profile terrorists, but we do profile motorcycle riders.

My week starts, and I'm in a deposition on a motorcycle accident. The attorney taking the deposition goes off on one of the witnesses, who happens to be a motorcycle savvy rider himself. Have you ever crashed? (Remember, this is just the witness - not the injured rider?). Aren't motorcycle crashes common? Don't motorcycles crash even when they are riding all alone and take a turn too fast? Etc. etc., and so forth.

When I point out that this is nothing but discriminatory motorcyclist bashing, and that it has no relevance to the accident we are litigating (which was caused by this lawyer's client), the lawyer defends himself by saying he is a rider himself! How crummy is that?

I guess its just the nature of our society that every case of an injured motorcyclist requires dealing with these negative preconceptions.

Attorneys More Important Than Ever

Many of the insurance carriers facing claims from motorcycle riders injured by unsafe automobile drivers have increased the extent to which they stall on paying claims. Always slow pay, the recession seems to have caused an epidemic of delay.

Part of the problem can be traced to a continued downsizing in the claims departments of many automotive insurance carriers. Some claims departments have been moved to less expensive out of state locations, some even have claims people working from home. Combined with the economy, the claims people remaining with the carriers are ever more reluctant to step up to the plate and evaluate cases.

The result has been ever more reliance on attorneys to perform the claims function by recommending settlements. There are a number of problems with this approach. The first problem, of course, is that most attorneys are reluctant to evaluate a case until they have done everything they can to look for an out. This means getting duplicate copies of medical records, taking unnecessary depositions, and having biased defense oriented medical doctors prepare defenses to the medical claims being made. All of this is expensive for everyone, and seriously delays bringing the case to an end.

The situation is that much worse, however, because the carriers are now squeezing the attorneys even harder. That makes the attorneys fear losing the business, and results in the attorneys being afraid to recommend a reasonable settlement.

Even cases where the defense admits fault (a rarity, for sure), and the injuries are serious enough to require surgery, are going without any settlement offer until shortly before trial.

I don't yet see a solution, although I am seeing the insurance companies being hit with verdicts that exceed their policy limits. Hopefully, at some point, the insurance commissioner will step up to the plate. Of course, this isn't likely while he is running for governor and looking for campaign money.

In the meantime, the best course of action is to press the carriers with a good lawyer, filing suit early, and pushing the cases through the courts.

Motorcycle Design

An interesting blog post about Volkswagen's 20% ownership of Suzuki and designer Nils Poschwatta's drawing of what a VW influences Suzuki would look like, made me think about some of the intangible requirements for a favorite motorcycle. Here is the design:

What I like in certain vehicles is a "swiss army knife" sense of utility. Lots of Beemers have this. In the automotive world, VW used to have this, and still occasionally gets it, Saab used to have it in their peculiar way, Volvo lived it in certain models. Honda's Hawk and CB750's had a motorcycle version of it.

It's an interesting concept, because really, it doesn't mean much. Little things, like extra electric plugs, play on this. Rides with solid feel and plainer styling tend towards it. An absence of leading edge power and technology seems to help.

Mostly, though, it is just a sense that the vehicle will reliably do whatever is required, with styling that reinforces this sense.

As a result, real or not, the rider feels confident that the bike will take whatever is thrown at it, mile after mile. A solid feel, a certain plain aura. It may not even be real. Simple, easy to fix, basic. Like a Swiss Army knife.

A lot of the cost of a motorcycle is the cost of setting up to manufacture it. Not as bad as tooling on a car, but still. The bikes I am talking about have a lasting quality, like a Norman Rockwell painting. You like them better as you put on the miles.

No doubt many riders are missing what I am getting at here. I think a lot of high mileage riders, however, will understand it.

To me, these are some of the characteristics of a bike you grow to love over time. Hard to describe, but easy to discover. In other words, a bike that just plain works, and looks it.

I like the Poschwatta design, a lot, and look forward to things to come from the collaboration.

J D Power Motorcycle Satisfaction Survey Results

I almost missed the 12th annual study of motorcycle ownership experience by J.D. Power. Almost, but not quite.

With motorcycle sales at a huge low due to the recession, they found that for the seventh straight year, riders were happier with their ownership experience.

One of the local shops had a parts guy who described two different types of motorcycle owners. One read all the magazines, and had to have the latest and greatest, leading edge model. The other, and I think more typical, rider was easier to please. This was the rider who felt that they were getting an awful lot for the money, and just enjoyed their bikes.

The J.D. Powers survey of about 8,000 owners measured five
factors measured quality, cost of ownership, sales, and service. Interestingly, the biggest increase came in the areas of sales and service. This is counter-intuitive for those who most notice that the bikes themselves keep getting better in so many ways.

Of course, this is also true, as the study PR release describes: "product quality has
improved compared with 2008, primarily due to a decrease in the number
of engine and braking/ride problems experienced. On average, the
overall number of problems reported is 126 problems per 100 vehicles
(PP100), which is an improvement of 26 PP100 since 2008."

Industry sales are down about 30%. Can you conclude that when times get tough, the industry tries harder? I dunno. Seems like things were getting consistently better well before times got tough.

In any event, I'll take it.

I finally got a hands on demonstration of the BMW version of D3O body
armor, which BMW calls NP. I happened to be near CAL Moto in Mountain
View, a great shop run by enthusiasts Kari Prager and Mike Meissner.
They carry a lot of the BMW product line, and I got a hands on
demonstration of the BMW version of this high tech product.

Before
getting into the details, let me say a few words about the BMW version
of this material. BMW's version is substantially thicker, and looks a
little more rubber like than the thinner 3DO, which has a lot more
texture. BMW claims (which charts and graphs) that their material
provides a substantially higher level of protection than the thinner
material.

Anyway, the demonstration is that if
you push on the rounded part of, for example, a shoulder piece, it will
slowly push flat. On the other hand, if you hit it with a fist, it
hardens so fast that it won't ever get flat. I did it a few times, and
it was fun. I am convinced that this is a good and useful technology,
and a major improvement over regular body armor.

I
tried on a jacket fitted with the armor, and I have to say that, at
least in the BMW version, there is still a substantial amount of
weight. On the other hand, the armor seems to mold well to the body,
and there was a lot less of the "Ricky Racer" look.

As
always, it will take time to see how this new product performs in the
field. In the meantime, I am including it in the selection process for
any new protective clothing.

If you are
thinking about new gear that includes body armor, I seriously suggest
that you check this one out. It may change your thinking.

The Right Mix is an Individual Choice

I just finished talking to another potential client who had a slide down the highway due to someone else's negligence. Happily, it seems that this crash resulted in relatively minor injuries. I can't tell you how enthusiastic the rider was about the way that his helmet and gloves performed.

Safety gear is an individual thing. There are no real US standards, only European ones. There is plenty of dispute about what works, and in what situation. Nothing is designed specifically for accidents that involve motorcycles and impact with cars or impact from cars. Some situations can arise where excellent track gear can actually make an injury from a crash with a car worse.

Safety gear doesn't help, unless you wear it. Some great gear can make you so warm that it can affect your ability to think clearly. It is also a matter of personal preference. After all, there are no standards or requirements in the US other than for helmets. Anything you choose to wear is just that, a choice.

On the other hand, there is a lot of conflicting information out there. New technology complicates the picture. Now there are several companies making air bag suits. Real data is scarce. The manufacturers, of course, all believe they have the answer to everything. Time will tell. Even there, the data collection is poor. Real studies are few and far between. Motorcyclists discuss these issues through a pipeline with other riders. With motorcycle magazines, maybe a consensus arises.

Until things become clearer, I will continue to periodically review and report bits and pieces on protective gear. So will others.

In the meantime, we will all make our individual choices, and report our individual experiences. How different this is from the many available governmental and private studies that report on safety devices for the drivers of automobiles.

UK Safety Rating System Results Touted By Manufacturer

It's about time to look at a new lid. As a long time Arai, and occasional Shoei, user, I have looked at some of the innovative safety features of Shark helmets from time to time. Here is the Shark RS2 Duhamel Model:

Readers of this blog know that I have also been a fan of the UK's Sharp program, where helmets are rated from one to five stars. This is designed to allow riders to simply purchase five star helmets, with a good chance that they are buying the safest helmets available. I predicted that this would make huge changes for the helmet world.

They advertise the following impressive list of features:

* Shell made from Carbone-fibre/Kevlar multidirectional composite fibres.
* Five different sizes of polystyrene absorber.
* Two shell sizes.
* Multi-element internal shock-absorber (6) with differentiated density.
* Airflow directed by integrated ducts.
* F1 type enhanced safety 3 mm visor.
* Dual treated (anti-scratch/anti-fog) "Total Vision" visor.
* "Push One" visor quick release system using 4 anchorage points.
* Very high flow ventilation system with easy opening vent.
* Optimised demisting thanks to "Venturi" side extractors.
* Fully adjustable, removable and washable interior using top-of-the-range fabrics Cool Max® and Sanitized®.
* Ergonomic cheek pads in 3D foam.
* Double-D ring "Racing" chin strap.
* Anti-fog mask and chin cover for visor as standard.
* High-performance anti-fog "Winter" mask as standard.
* Supplied with tear-offs. *Weight : 1290g (± 50g).
* Lightest helmet in its class
* Meets or exceeds D.O.T. and ECE 22-05 standards
* 5 years warranty

I am embarrassed to make such an obvious pitch for a helmet, or any motorcycle safety product. I have no relationship of any kind to Shark, and there is no benefit to me if they do, or don't sell helmets.

I haven't tried one for fit or comfort yet, but if I do end up buying one, I will do a review. Otherwise, look for another Arai.

Will Try for Prize at Isle of Man

As a fan of Michael Czysz, I would really like to see him get some racing satisfaction.

Everyone says the bikes are fantastic. Certainly the engineering is way forward. But so far, they just haven't had the success that many would like them to see.

So it will be very cool to watch their Isle of Man effort this year. The bike has a carbon fibre frame, 220 horsepower, and is under 350 pounds.

According to race promoters, the newly named TT Zero race (zero emissions, of course) is scheduled to run June 9, and is only a one lap race. There is a 10K pound prize to the first team that does a 100mph lap. In the case of more than one bike, the prize goes to the fastest team.

Given all of the chassis work that has been done, I have to believe that the MotoCzysz team has a good shot at doing well.

National Garage Events and Special Programs

Harley Davidson points out that women riders comprise 23% of all motorcycle riders, and are now the fastest growing group of riders.

In order to encourage new riders, they are setting up a national program of garage events at dealers. These events will introduce basic motorcycle controls, gear, customization, and information about buying a new motorcycle. They will even demonstrate how to pick up a downed bike.

Once riders have an interest, they can go to a new Harley web site that walks them through the process of financing, buying, and customizing a motorcycle, together with information about getting licensed, and learning and practicing riding.

Whether or not you are a Harley follower, Harley's contribution to motorcycle riding is dramatic, and continues to drive motorcycling into the future. THey are to be congratulated for addressing this new group of riders.
