At The Scene

Motorcycle Lawyer Sees Accident
In a surreal event, my wife and I were in traffic on the way to Tahoe, and talking about the many riders splitting lanes past us to beat the bad traffic.

Some were lousy riders, way over their heads.  Some were going too fast.  Some were irritating drivers with loud exhausts and aggressive riding styles.

One rider, riding well, traveling at a reasonable speed, was notable because of wide bags.  (Ducati ST4) Well, the bags looked wider, because of their shape.  Next thing you know, a car pulled into him, and he went down.

My wife got a good look at the accident, being in the passenge seat.  She left her name and number, although no one has called for her statement.

A self professed Harley rider hopped out of his car to help.  We moved the motorcycle with the help of a third person who stopped (and with the rider's blessing).

An off duty detective got into traffic, to keep things moving.  We called 911.  When we left, everything was in control, we were told an officer was on the way, they had our information, and knew that we saw what happened.

The driver of the car was as decent as could be, and helpful to the injured rider.

The rider had a shoulder injury of some substance, and said that the car came over on him.

The professed Harley rider assured the car driver that "I've got you covered, I saw the whole thing - he hit you".

I can tell you that, while there may be controversy over exactly where the impact occurred, the rider was going straight, lane splitting at a reasonable speed.  In my opinion, he absolutely did not turn into the car.  Yet here was a self-professed fellow rider, assertively offering to testify otherwise.  Note that I am not impugning his integrity, and certainly not suggesting that he was lying.  Instead, I suspect that he saw only the accident at or near the instant of impact.  Maybe he heard it, and that got his attention.  Maybe, even, he had a better view ofthe accident, and he is right.

Nonetheless, it was amazing how willing people are to jump on the bandwagon when a motorcyclist is injured while lane splitting.
